The Definitions and Interpretation
In these Terms and Conditions
“Operator” as referred is “Acclaim Travel (incorporating Ace Travel)”
“Hirer” as referred is the person booking the Operators service
“Associates” as referred is the Co-partners the Operator use in times of high demand and each having their own liability covered individually.
1. Vehicles
All vehicles used by the Operator and their chosen Associates will be sufficiently insured and licenced by the appropriate Authority for hire and reward travel and must not exceed the maximum number of passengers as denoted by the Licencing Authority.
2. The Use of Other Operators Vehicles
The company reserves the right to substitute other Operators’ vehicles in place of its own for any journey or part thereof.
3. Supplying Vehicles with Additional Seating Capacity
The company reserves the right to supply a larger vehicle than that ordered for any journey and in this event, no additional charge shall be made to the Hirer unless the additional seating capacity is utilised. If you must have the size of vehicle you requested, please let us know at the time of booking as this may affect your quote.
4. Use of the Vehicle
The Hirer cannot assume the use of the vehicle between outward and return journeys, nor that will it remain at the destination of the Hirer’s use unless this has been agreed with the company in advance.
5. Bookings
Each booking must be made in advance of the hiring, directly with the Operator. During periods of high demand the Operator maintains the right to pass certain bookings onto Associates where necessary.
6. Payment Terms
Balance of payments (less deposits) are due no later than the date of the hiring and should be paid on the initial outward journey by either cash or debit or credit card to the driver. For airports/seaports payments these can be made per leg of the journey (ie 50% each way) should you prefer. For bank transfers & cheque payments these must be made 72 hours prior to the booking.
6a. Payment Terms (Deposits)
A £50 deposit for all airports (excluding Southend Airport) is payable at the time of booking. For all other trips (including Southend Airport) a 40% deposit (of the total cost of the hiring) is required at the time of booking. Due to the nature of the business booking deposits are non-refundable but in certain circumstances this can be held over to a future hiring, with prior agreement with the owner.
7. Additional Charges
The company reserve the right to impose additional charges on the Hirer following completion of the hire if the passengers have left the vehicle in an unreasonably untidy condition or having required additional time or mileage which was not included for in the original booking.
8. Passenger Capacity and Seat Belts
No passenger may be carried in excess of the seating capacity of the vehicle and passengers must wear the seat belts provided at all times.
9. Consumption of Alcohol
The consumption and or carrying of alcohol in the passenger compartment of company vehicles is strictly forbidden unless permission has been obtained from the company.
10. No smoking policy
Hirer’s should note that this company operates a policy of no smoking (including vaping) on all company vehicles. This policy will be strictly enforced. Please bring this condition to the attention of all passengers intending to travel on the vehicle.
11. Liability for Injury
The company will not accept any liability for damage, injury or loss for any passenger standing up or not properly seated, using a seatbelt whilst the vehicle whilst in motion.
12. Delays/Amendments/Cancellations of service to Airport or Ferry Transfers (not restricted to)
Where there has been a 3rd party change to a service (such as flight change or cancellation but not restricted to) the Hirer must inform the Operator as soon as possible. The Operator will endeavour to accommodate all changes but depending on the severity of the delay or change it may not be possible in all cases to do so. In the unlikely event the Hirer shall not be financially disadvantaged and payment received (not exceeding the amount paid) for unfulfilled services will be refunded to the Hirer.
13. Breakdown and Delays
The Operator gives its advice on journey times based on experience and gives this in good faith. However, it is the Hirer’s responsibility to ensure that there is sufficient time for their journey as a result of breakdown or traffic congestion, or other events beyond their reasonable control, the Operator will not be liable for any loss or inconvenience suffered by the Hirer as a result.
14. Cancellation by the Hirer
The Hirer should immediately contact the Operator once they are aware that their booking cannot proceed. The Operator will endeavour to try and reschedule work so that they are not financially disadvantaged, and only if successful will endeavour to refund any payment/deposit accepted for the booking. However the Operator has the right to retain any advance payment in order to reduce their financial loss as a result of the cancellation.
15. Cancellation by the Operator
Once a booking is confirmed by the Hirer, it is extremely unlikely that the Operator will ever cancel a hiring (providing the payment terms have been adhered to). In cases of extreme weather conditions or exceptional circumstances which are out of the Operators control, the Operator will liaise with the Hirer as soon as possible and make every reasonable effort to make sure the hire is completed, where possible. In the unlikely event that the Operator has to cancel a booking any pre-payment received by the Operator for the unfulfilled service will be funded.
16. Passengers’ Property and Lost Property
a) All vehicles hired by the company are subject to restrictions on carrying luggage for statutory safety reasons. Large bulky items may not be able to be carried and the Hirer should take all steps to notify the company in advance of such requirements.
b) The company accepts any personal property of the Hirer and their passengers on the understanding that it will take all reasonable steps to avoid loss or damage. The Hirer should notify the company or the driver if items of exceptional value are to be carried on the vehicle. It is the Hirer’s responsibility to minimise risk of loss when property is left unattended.
c) The company will not be responsible for any damage to, or loss of, personal property left in vehicles, howsoever caused.
d) All articles of lost property recovered from the vehicle will be held at the company’s premises where the vehicle is based for a period of 7 days.
17. Acceptance of Our Quotation
Implies acceptance of the above conditions.
